Rule of Law and human rights in Europe and the EU


The Rule of Law plays a fundamental role in anchoring economic, social, and cultural rights in national constitutions, laws, and regulations. Rule of Law and human rights have an intrinsic and mutually reinforcing relationship - respect for human rights informs all Rule of Law elements, such as legality, legal certainty, the prohibition of arbitrariness, access to justice, and equality before the law. Conversely, the protection and promotion of human rights are realised only through respect for the Rule of Law. Research and events under this theme explore topics related to Rule of Law "backsliding" in EU and Council of Europe members and national and supranational responses, as well as the operationalisation of the Charter of Fundamental Rights of the EU and the European Convention on Human Rights (ECHR) in relation to the independence of the judiciary and other Rule of Law standards.
