Event Details
The separation between international human rights law and international investment law leads to a fragmented approach, making it challenging to integrate human rights into investment decision-making and dispute resolution.
There is often a lack of clarity on how obligations related to human rights interact with the protections granted to investors under international investment agreements. States might struggle to enforce HRDD requirements on investors without facing claims of indirect expropriation or unfair treatment.
The duty to respect human rights applies to corporations, but the enforcement mechanisms under international investment law typically focus on state obligations, leaving a gap in direct corporate accountability for human rights abuses.
Some states and international bodies are advocating for reforms to include explicit references to human rights and HRDD in IIAs, aiming to create a more balanced framework that supports both investment and human rights.
The HRDD Forum and Investment Treaty Forum bring together experts in respective fields to discuss these and other relevant topics at this members-only event.
